Lewes Beach is the area east of the Lewes-Rehoboth Canal. If you have crossed the bridges from town, you're now on Lewes Beach. Homes on Lewes Beach have a quirk. Because of the way the original land grant was written, all land east of the canal is owned by the town of Lewes in perpetuity. When you purchase a home on Lewes Beach, it will not be held in fee simple.


The home you purchase will have a 99 year leasehold which is treated like a fee simple ownership for a mortgage. The 99 year leases on Lewes Beach also have no periodic payment outside of your obligation to pay property taxes. These leases do renew.


Like other beach areas, Lewes participates in a FEMA program to help manage flood risks which does place certain requirements on homeowners. It is important to work with a local agent who understands how these rules can impact what you can do with a home you intend to purchase.
